Terms & Conditions

These Terms and Conditions govern the tourist rental of the property "Charme in Spello" located at Via Porta Prato 6, 06038 Spello (PG), CIN IT054050C245036513.

1. Identification of the Parties

1.2 Guest

The Guest is the natural person who makes the booking and assumes responsibility for compliance with these conditions for themselves and all guests who will stay at the property.

2. Subject Matter of the Contract

The Landlord grants the property called "Charme in Spello" for tourist rental, fully furnished and equipped with all the comforts necessary for a short stay for tourist and recreational purposes.

3. Duration and Booking

3.1 Rental Period

The rental period is the one agreed upon at the time of booking, with indication of check-in and check-out dates.

3.2 Times

• Check-in: from 15:00 to 20:00
• Check-out: by 10:00

Different times must be agreed in advance with the Landlord. Late check-ins may incur an additional charge.

3.3 Booking Confirmation

The booking is considered confirmed upon receipt of the deposit payment or the full amount as communicated by the Landlord.

4. Rates and Payment Methods

4.1 Price

The price of the rental is the one agreed upon at the time of booking and includes:

• Use of the property and all furniture and equipment;
• Utilities (water, electricity, gas, heating);
• Linens (sheets and towels);
• Final cleaning (in normal conditions);
• Wi-Fi;
• Parking space (if available).

4.2 Payment Methods

Payment must be made according to the following methods:

• Deposit: 30% of the total at the time of booking;
• Balance: the remaining 70% at least 7 days before check-in;

or

• Full payment: 100% of the total at the time of booking.

4.3 Security Deposit

At check-in, a security deposit of €200.00 may be requested to guarantee any damages. The deposit will be returned within 7 days of check-out, subject to verification of the property's condition.

5. Cancellations and Modifications

5.1 Cancellation by Guest

• Up to 30 days before check-in: 100% refund of the amount paid;
• From 29 to 15 days before check-in: 50% refund of the amount paid;
• From 14 days before check-in: no refund.

5.2 Cancellation by Landlord

In case of cancellation by the Landlord due to force majeure, the Guest will be entitled to a full refund of the amount paid.

5.3 Booking Modifications

Any requests to modify the dates are subject to availability and must be agreed in writing with the Landlord.

6. Guest Obligations

6.1 Use of the Property

The Guest commits to:

• Use the property exclusively for tourist residential purposes;
• Keep the property in good condition and clean;
• Comply with condominium regulations and public peace regulations;
• Not exceed the maximum number of guests indicated;
• Not sublet or transfer the property to third parties;
• Not keep pets without prior written authorization;
• Comply with the smoking prohibition inside the property;
• Promptly report any malfunctions or damage.

6.2 Number of Guests

The maximum number of guests allowed is the one agreed upon at the time of booking. Hosting of undeclared persons may result in immediate contract termination without any refund rights.

6.3 Communication to Public Registers

The Guest is required to provide identification documents for all guests for mandatory reporting to public security authorities, pursuant to article 109 of T.U.L.P.S.

7. Landlord Obligations

The Landlord commits to:

• Deliver the property clean and in perfect working order;
• Guarantee the property's conformity as described and illustrated;
• Provide assistance if needed during the stay;
• Respect the guests' privacy during their stay.

8. Liability

8.1 Damages

The Guest is responsible for any damage caused to the property, furniture and equipment during the rental period, and undertakes to compensate the Landlord for the full amount of the damage.

8.2 Theft and Loss

The Landlord is not responsible for theft, loss or damage to personal items left by the Guest at the property.

8.3 Service Interruptions

The Landlord is not responsible for temporary service interruptions (water, electricity, gas, internet) due to force majeure or maintenance interventions by service providers.

9. Access to the Property

The Landlord reserves the right to access the property, with at least 24 hours notice, for:

• Checks on the property's condition;
• Urgent maintenance interventions;
• Visits by potential future guests (only in case of emergency).

10. Contract Termination

The Landlord reserves the right to immediately terminate the contract, without any notice or refund, in case of:

• Violation of these conditions;
• Behavior that causes disturbance to other condominium residents;
• Use of the property for illegal purposes;
• Presence of a number of guests exceeding the agreed number;
• Serious damage to the property or furniture.

11. Force Majeure

Neither party will be liable for non-performance due to force majeure (natural disasters, wars, epidemics, government measures, etc.). In such cases, a proportional refund for the unused period will be provided.

12. Personal Data Processing

The Guest's personal data will be processed in compliance with EU Regulation 2016/679 (GDPR) as indicated in the Privacy Policy.

13. Applicable Law and Competent Court

13.1 Applicable Law

This contract is governed by Italian law.

13.2 Competent Court

For any dispute arising from this contract, the competent jurisdiction is the Court of Perugia.

14. Dispute Resolution and Alternative Methods

Pursuant to EU Regulation No. 524/2013, the Guest, as a consumer, has the right to resort to an alternative dispute resolution body or the European online dispute resolution platform (ODR), available at the following link: https://ec.europa.eu/consumers/odr

15. Communications

All communications between the parties must be made in writing via:

16. Severability Clause

Should one or more clauses of these Terms and Conditions be declared null or ineffective, such nullity or ineffectiveness will not result in the nullity of the entire contract, which will remain valid and effective for the remaining clauses.

17. Amendments to Terms and Conditions

The Landlord reserves the right to modify these Terms and Conditions at any time. Modifications will be published on the website with indication of the last update date.

18. Acceptance

The booking and the payment of the deposit or the full amount constitute full acceptance of these Terms and Conditions.
